Please read these terms carefully before using our services or website. By engaging with Synergy Painting, you agree to these terms.

Effective Date: January 1, 2026
Last Updated: January 1, 2026

These Terms of Service ("Terms") govern your use of the Synergy Painting website and the painting and remodeling services provided by Synergy Painting ("we," "us," or "our"), serving Lake Oconee and surrounding areas. By accessing our website, submitting a request for services, or entering into a service agreement with us, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Acceptance of Terms

By using our website, submitting a contact or quote request form, communicating with us by phone or email, or hiring Synergy Painting to perform any services, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

These Terms apply to all visitors, users, clients, and others who access or use our website or services. If you are entering into these Terms on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

Your continued use of our website or services constitutes your acceptance of these Terms. We recommend that you review these Terms periodically as they may be updated from time to time.

Services Provided

Synergy Painting provides professional painting and remodeling services, including but not limited to:

  • Residential interior and exterior painting
  • Commercial interior and exterior painting
  • Sheetrock and drywall repair
  • Cabinet painting and finishing
  • Wood staining — interior and exterior
  • Epoxy floor coatings

All services are subject to the availability of our crew, weather conditions where applicable, and mutual agreement on project scope, timeline, and pricing. We reserve the right to decline any project at our discretion.

The specific scope of work, materials to be used, and project expectations for each individual job will be outlined in the written estimate or agreement provided to you prior to the start of work.

3

Estimates & Pricing

Synergy Painting provides free, written estimates for all projects. All estimates are based on an on-site assessment of the project scope and are valid for a period of 30 days from the date issued unless otherwise stated.

Estimates are based on the information available at the time of assessment and assume normal working conditions. The following may result in additional charges beyond the original estimate:

  • Additional surface preparation required beyond what was visible or anticipated during the initial assessment
  • Discovery of hidden damage such as rot, moisture issues, or structural concerns
  • Client-requested changes to the scope of work after the estimate has been accepted
  • Significant increases in material costs due to supply chain or market conditions
  • Additional coats of paint or primer required due to unforeseen surface conditions

If additional costs are anticipated during the course of a project, we will notify you promptly and obtain your approval before proceeding with the additional work.

All prices are quoted in U.S. dollars. Estimates are not contracts until formally accepted by both parties. A written acceptance of the estimate or a signed agreement is required to schedule and begin work.

4

Payment Terms

Payment terms will be outlined in your written estimate or service agreement. General payment terms are as follows:

  • Deposit — a deposit may be required prior to the start of work for larger projects. The deposit amount will be specified in your estimate or agreement.
  • Progress Payments — for larger or multi-phase projects, interim payments may be required at agreed-upon milestones.
  • Final Payment — the remaining balance is due upon satisfactory completion of the project unless otherwise agreed upon in writing.

We accept payment by cash, check, and other methods as communicated at the time of your project. Payment is due in full upon receipt of your final invoice unless a payment plan has been specifically agreed upon in writing.

Late Payments: Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend or withhold services for accounts with unpaid balances.

In the event that a check is returned due to insufficient funds, you will be responsible for any bank fees incurred as a result, in addition to the original invoice amount.

5

Scheduling & Cancellation

Project start dates are scheduled based on crew availability and are subject to change due to weather conditions, prior project delays, or other circumstances beyond our control. We will communicate any scheduling changes to you as promptly as possible.

Client Cancellations: If you need to cancel or reschedule a project, please notify us at least 48 hours in advance. Cancellations with less than 48 hours' notice may result in forfeiture of any deposit paid, as materials may have already been ordered and crew time allocated.

Weather Delays: Exterior painting and certain other services may be delayed due to weather conditions such as rain, extreme temperatures, or high humidity. These delays are at our professional discretion to ensure the best possible finish quality and are not subject to cancellation penalties.

Our Right to Reschedule: We reserve the right to reschedule projects due to crew availability, equipment issues, or circumstances beyond our control. We will provide you with as much advance notice as possible and work with you to find a mutually agreeable alternative date.

6

Client Responsibilities

To ensure the successful and timely completion of your project, clients agree to the following responsibilities:

  1. Site Access — provide safe and timely access to the work areas on the scheduled project days. This includes access to all rooms, surfaces, or areas to be painted or repaired.
  2. Area Preparation — remove or relocate furniture, personal items, valuables, and fragile objects from work areas prior to the start of work. While we take every precaution to protect your belongings, we are not responsible for damage to items that were not moved prior to our arrival.
  3. Pets and Children — ensure that pets and children are kept away from active work areas for their safety and to allow our crew to work safely and efficiently.
  4. Utilities — ensure that electricity and water are available at the work site, as these may be required for certain services.
  5. Accurate Information — provide accurate and complete information about the project, including any known issues with surfaces, prior coatings, or structural concerns that may affect the work.
  6. Timely Decisions — respond promptly to requests for color selections, approvals, or other decisions that may be required to keep the project on schedule.

Failure to meet these responsibilities may result in project delays, additional charges, or rescheduling. Any additional time or materials required due to the client's failure to prepare the work area may be billed at our standard rates.

7

Workmanship & Warranty

Synergy Painting is committed to delivering high-quality results on every project. We stand behind our work and address any workmanship concerns promptly and professionally.

Workmanship Warranty: We warranty our workmanship for a period of 1 year from the date of project completion. During this period, if defects in workmanship are identified — such as peeling, cracking, or significant fading attributable to application errors — we will return to address and correct the issue at no additional cost to you.

Our workmanship warranty does not cover:

  • Damage caused by normal wear and tear, weather exposure, or environmental factors beyond our control
  • Damage caused by physical impact, misuse, or neglect
  • Issues resulting from pre-existing structural or surface conditions that were present prior to our work
  • Color fading or chalking consistent with the normal lifespan of paint products
  • Work performed or modified by others after project completion
  • Issues resulting from client-supplied materials or paints

Material Warranty: Paint and material manufacturers provide their own product warranties. We use premium-grade paints and materials but cannot guarantee manufacturer warranties beyond what is offered directly by the manufacturer.

To initiate a warranty claim, please contact us within the warranty period at [email protected] or (706) 920-6989. We will assess the issue and schedule a return visit at our earliest availability.

8

Limitation of Liability

Synergy Painting is fully licensed and insured. We carry general liability insurance to protect against accidental property damage or bodily injury that may occur during the course of our work.

In the event of accidental property damage caused directly by our crew during the performance of services, please notify us immediately. We will work to resolve any such claims through our insurance carrier in a prompt and fair manner.

To the maximum extent permitted by applicable law, Synergy Painting shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages of any kind
  • Loss of use, revenue, profits, or business opportunities
  • Damage to items not properly moved or protected prior to our arrival
  • Pre-existing damage to surfaces, structures, or property
  • Delays caused by weather, supply chain issues, or circumstances beyond our control

Our total liability to you for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific service that is the subject of the claim.

Dispute Resolution: In the event of a dispute between you and Synergy Painting, we encourage you to first contact us directly to resolve the matter informally. Most concerns can be resolved quickly and amicably through direct communication. Please reach out to us at [email protected] or (706) 920-6989 before pursuing any formal legal action.

If informal resolution is not possible, the parties agree to attempt to resolve the dispute through mediation before resorting to litigation. The costs of mediation shall be shared equally between the parties.
